These Terms of Service ("Terms") govern your access to and use of 4kayevents.com

and the 4Kay Event Pros marketplace. By creating an account, requesting a quote,

or accepting a booking, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under U.S. law to use the Service. By using the Service you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@4kayevents.com if you suspect unauthorized access.

3. The marketplace

4Kay Event Pros is a venue that connects customers with independent third-party vendors. We are not a party to any contract for services between a customer and a vendor. Vendors are independent contractors and are solely responsible for the services they offer, the equipment they provide, and their compliance with applicable laws (including licensing, insurance, and tax obligations).

4. Quotes, bookings, and payments

  • Customers submit quote requests; vendors respond with estimates.
  • A booking is formed when the customer accepts an estimate and pays the required deposit through our payment processor (Stripe).
  • Payments are held and disbursed according to the booking terms. A 5% processing fee (covers our payment processor's charges — not profit) is disclosed at checkout and in your booking record. Refunds and cancellation policies are also disclosed there.
  • All amounts are in U.S. dollars unless otherwise stated.

5. Vendor terms

If you register as a vendor you additionally agree to: provide accurate business and licensing information; maintain appropriate insurance; honor accepted bookings; communicate promptly; comply with our payout flows (Stripe Connect); and follow safety standards including ASTM/F2374 (inflatables) and applicable state and local rules.

6. Customer responsibilities

You will provide accurate event details, an appropriate setup area, access to power and water if required, adult supervision of attractions, and timely payment. You will not misrepresent guest counts, venue conditions, or use vendors' equipment for unlawful purposes.

7. Acceptable use

You agree not to: violate any law; infringe others' rights; upload harmful code; scrape or reverse engineer the Site; harass other users; or attempt to bypass our safety, payment, or security systems.

8. Reviews and content

You retain ownership of content you submit (reviews, photos, messages) and grant 4Kay Event Pros a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service. We may remove content that violates these Terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VENDORS WILL MEET YOUR EXPECTATIONS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4KAY EVENT PROS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED DOLLARS (US$100).

11. Indemnification

You agree to defend, indemnify, and hold harmless 4Kay Event Pros from any claim, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms.

12. Dispute resolution and arbitration

Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules in State of Texas, United States, except that either party may bring an individual claim in small-claims court. You and 4Kay Event Pros each waive the right to a jury trial and to participate in any class or representative action. You may opt out of arbitration by emailing support@4kayevents.com within 30 days of first accepting these Terms with the subject "Arbitration Opt-Out".

13. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules.

14. Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Service. You may close your account at any time by emailing support@4kayevents.com.

15. Changes

We may update these Terms. Material changes will be highlighted, and signed-in users will be asked to re-acknowledge. Continued use after a change constitutes acceptance.
